What Is Notice 35(3) BNSS?

Under the Bharatiya Nagarik Suraksha Sanhita (BNSS) 2023, Section 35(3) allows the police, including Cyber Crime Units, to issue a written notice to any person whose information, presence, documents, or clarification is required for an investigation.

Before BNSS, a similar provision existed in CrPC under Section 41A, but BNSS has replaced CrPC completely.

Notice 35(3) BNSS is not an arrest order.

No.
It is not:

→ an arrest warrant
→ a charge sheet
→ a proof of guilt

It is only a request for cooperation during investigation.
