What Is a Mule Account? Why Cyber Cell Freezes or Puts Lien on Bank Accounts and How to Stay Safe
With the rapid increase in online fraud, crypto (USDT) P2P trading, and digital payments, many innocent people are facing sudden bank account freezes or lien holds by Cyber Cell. In most cases, the account holder has not committed any fraud, yet their account is tagged as a “mule account.”
This blog explains everything you need to know in detail.
What Is a Mule Account?
A mule account is a bank account that is used—knowingly or unknowingly—to receive, transfer, or layer money obtained from cyber fraud.
Important Point
👉 Being a mule does NOT always mean you are a criminal.
Many mule accounts belong to innocent victims who received money for:
-
Freelancing work
-
P2P crypto (USDT) sale
-
Task-based income
-
Help to friends or acquaintances
-
Commission-based payments
Common Types of Mule Accounts
-
Unknowing Mule – Innocent person, no criminal intent
-
Knowing Mule – Person knowingly helps fraudsters
-
Crypto/P2P Mule – Funds received after selling USDT/crypto
Most Cyber Cell cases involve unknowing mules.
Why Does Cyber Cell Put Lien or Freeze on Accounts?
When a cyber fraud occurs, the stolen money moves through multiple bank accounts very fast. Cyber Cell follows the money trail.
If your account:
-
Received money linked to a fraud complaint
-
Is part of a transaction chain
-
Received funds from a suspected source
Then Cyber Cell may:
-
Put lien on the disputed amount, or
-
Freeze the entire debit of the account (often wrongly)
This action is usually taken under:
-
NCRP complaint investigation
-
CrPC Section 102
-
Internal Cyber Cell SOPs
Lien vs Freeze – Understand the Difference
Lien
-
Only the disputed amount is blocked
-
Remaining balance should be usable
-
Legally preferred method
Full Debit Freeze
-
Entire account becomes unusable
-
Salary, savings, emergency funds blocked
-
Often disproportionate and challenged in courts
Many High Courts have clearly stated that full account freeze is excessive when only a part of money is disputed.
Why Innocent People Get Trapped
You may become a mule unknowingly if:
-
You sold USDT in P2P and received money
-
A friend/shared contact gave your bank details to someone else
-
You received payment from a third party
-
You did not know the source was later flagged as fraud
In such cases, intent (mens rea) is missing, which is very important in law.
How to Stay Safe from Mule Account Tagging
1. Avoid Third-Party Payments
-
Receive money only from the person you dealt with
-
Avoid “my friend will pay” arrangements
2. Keep Proper Proof
Always maintain:
-
Chat screenshots
-
Transaction IDs
-
Purpose of payment
-
USDT/crypto wallet transaction hash
3. Do KYC-Verified P2P Trading
-
Use verified platforms
-
Avoid off-platform settlements
4. Do Not Share Bank Details Casually
Even with known persons, misuse is possible.
If Your Account Is Frozen or Lien Is Applied – What to Do
Step 1: Don’t Panic
Account freeze does not mean you are guilty.
Step 2: Get Details from Bank
Ask for:
-
Acknowledgement / NCRP number
-
Cyber Cell / Police Station name
-
IO / SI contact details
-
Whether it is lien or full freeze
Step 3: Prepare a Written Explanation
Your explanation should include:
-
Source of money
-
Nature of transaction (freelancing / USDT sale / etc.)
-
Relationship between parties
-
No criminal intent
-
Willingness to cooperate
Step 4: Email the Investigating Officer (IO)
Send a detailed, factual email requesting:
-
Clarification
-
Conversion of full freeze into lien (if applicable)
-
Removal of lien if money is legitimate
Attach:
-
Bank statement
-
Chat proofs
-
Crypto transaction proofs
-
Written confirmation from payer (if available)
Step 5: Provide Written Confirmation from Third Party
If money came via:
-
Friend
-
Common contact
-
Third party
Ask them to give a written declaration confirming:
-
Reason for payment
-
That money was against a genuine transaction
This helps a lot in lien removal.
How Lien or Freeze Gets Removed
Lien/freeze can be removed when:
-
Investigation confirms no wrongdoing
-
IO is satisfied with explanation
-
Written confirmations are verified
-
Court directions are issued (if needed)
In many cases, lien is removed at police level itself without court intervention.
Legal Protection Available
Indian courts have repeatedly held that:
-
Only disputed amount can be restricted
-
Entire account freeze violates Article 21 (Right to Life & Livelihood)
-
Arbitrary freezing can be challenged under Articles 226 & 32
These principles are often cited in representations to Cyber Cell.
